    By installing or using UpNew, you agree to these Terms. UpNew is a cosmetic and aspirational tool — not a medical, dermatological, or clinical service.
  

1. Who we are

UpNew (the "Service", the "App") is operated by Dr. Gotthilf LLC, a Wyoming limited liability company (30 N Gould St Ste R, Sheridan, WY 82801, USA). "We", "us", and "our" refer to Dr. Gotthilf LLC. "You" refers to the person using the Service. "App Store" means Apple's App Store; "Play Store" means Google Play.

2. Who can use UpNew

You must be at least 13 years old (16 in the EEA) to use UpNew. If you're under 18, use it only with the involvement of a parent or guardian. UpNew is offered for personal, non-commercial use. You may not use it on behalf of another person without their explicit consent, and you may not scan a photo of anyone other than yourself.

3. What UpNew does — and what it does not

UpNew runs an AI vision model over a selfie you take and returns (a) eight cosmetic sub-scores, (b) an AI-generated "New You" rendering in a chosen style, and (c) week-by-week focus recommendations.

UpNew is not a medical device, a diagnostic tool, a dermatological consultation, a substitute for professional advice, or a guarantee of any cosmetic outcome. "New You" renderings are AI illustrations — not predictions of how you will look after any treatment. Recommendations for products, haircuts, or routines are general aspirational suggestions, not personalised medical or aesthetic prescriptions. If you have a skin condition, medical question, or are considering any procedure, consult a qualified clinician.

4. Your account and data

UpNew does not use accounts. Your activity is keyed to an anonymous identifier stored on your device. If you uninstall the app or clear its data, that identifier is destroyed and your scan history becomes inaccessible — there is no recovery. 5. Subscriptions, billing, and refunds

UpNew is free to install. Some features (multi-style restyle, full readouts, trend timeline) require a Pro subscription, currently US$9.99 per month or local equivalent (price displayed in-app before purchase).

Where you pay: Subscriptions are managed and billed by Apple or Google. We never see your card.
Auto-renewal: Subscriptions renew automatically until you cancel. Cancel at least 24 hours before the renewal date through your App Store or Play Store account.
Refunds: Refund requests are handled by Apple or Google according to their refund policies (Apple: reportaproblem.apple.com; Google: play.google.com/store/account/orderhistory). We can support the request but cannot refund a purchase we did not collect.
Price changes: If we change subscription prices, you'll see the new price in-app and via the store before renewal; the new price will not apply to existing subscribers until they consent.

6. Acceptable use

You agree not to:

Scan a photo of someone other than yourself.
Use UpNew to create or distribute non-consensual imagery, deepfakes targeting third parties, or sexualised content involving any individual without consent.
Use UpNew to make medical, employment, insurance, or legal decisions about anyone.
Reverse-engineer, decompile, or scrape the Service or its outputs.
Resell UpNew outputs (including "New You" renderings) as your own AI product.
Abuse our infrastructure — automated scripts, scraping, or denial-of-service attempts will be blocked and may be referred for legal action.

We may suspend or terminate access for any of the above without notice.

7. Intellectual property

The UpNew app, website, brand, copy, and underlying inference logic are owned by Dr. Gotthilf LLC. The "New You" renderings generated for your scan are licensed to you for personal, non-commercial use — share them, print them, post them. You may not sell them or use them in a way that implies they are real photographs.

8. AI outputs and disclaimers

AI models are imperfect. Scores can vary across re-scans, renderings can produce artefacts, and recommendations may be unsuitable for your particular skin or hair type. We label every rendering "AI illustration — not a prediction" because that's the honest framing. UpNew is provided "as is" and "as available", without warranties of accuracy, fitness for a particular purpose, or non-infringement to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Dr. Gotthilf LLC and its members will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim, or US$50, whichever is greater. EU consumers retain rights that cannot be limited contractually; nothing here limits liability for gross negligence, wilful misconduct, or fraud.

10. Indemnification

You agree to indemnify Dr. Gotthilf LLC against claims arising from your breach of these Terms or your misuse of the Service, including any claim that you scanned a photo of a third party without consent.

11. Apple-specific terms (iOS users)

If you obtained UpNew through the App Store, you acknowledge: (a) these Terms are between you and us, not Apple; Apple is not responsible for the Service or its content; (b) Apple has no obligation to provide maintenance or support for UpNew; (c) Apple is a third-party beneficiary of these Terms and may enforce them against you; (d) Apple's standard EULA applies to your use of UpNew except where contradicted by these Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Disputes will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, except that consumers in the EU may bring a claim in the courts of their country of residence under applicable consumer-protection law.

13. Changes to these Terms

We may update these Terms. Material changes will be announced in the app and on this page with an updated "Last updated" date. Continued use of UpNew after the change means you accept the updated Terms.
